BILL NUMBER:S3858

Title of bill

An act to amend the vehicle and traffic law, in relation to performance of illegal maneuvers while operating a motorcycle

Purpose

Relates to illegal maneuvers while operating a motorcycle.

Summary of provisions

"Illegal maneuver" while operating a motorcycle is expanded to include any maneuver that requires the front or rear wheel to leave the ground.

An illegal maneuver that results in property damage or bodily harm of another shall be punishable by a fine of up to $2500 and revocation of operator's license and registration for one year.

An illegal maneuver that results in property damage or bodily harm of another within eighteen months of a prior conviction where the violator performed an illegal maneuver that resulted in property damage or bodily harm of another shall forfeit motorcycle and have operator's license and registration revoked for two years.

Justification

Social media sights and motorcycle clubs have been known to glamorize risky behavior such as "endo's" and "wheelies" that can result in the injury or death of others. We aim to target individuals who exhibit risky behavior patterns on motorcycle's in an attempt to curb such behavior with expensive consequences so that lives will be saved and injuries prevented.
