BILL NUMBER:S3902
Title of bill
An act to amend the economic development law, in relation to including video game developers in the excelsior jobs program
Purpose
To continue the development of video game jobs and companies in NYS
Summary of provisions
Section 1. Amends subdivision 14 of section 352 of the economic development law, and adds a new subdivision 20 to create a definition of a video game developer, and to include a video game developer who creates 20 net new jobs and makes a significant capital investment in the state as a regionally significant project.
Section 2. Amends paragraph (c) of subdivision one and subdivision three of section 353 of the economic development law to include a video game developer as eligible for the excelsior jobs program, and to set the same eligibility standard of five new new jobs, as for a software developer.
Existing law
New bill to add video game developers to the excelsior jobs program.
Justification
Last year the legislature added funds to the budget to create three gaming hubs at schools which offer advanced degrees in game development. This was seen as a help to the schools development of startup zones with a concentration in the area. A third leg, beyond infrastructure and workspace, is incentivizing video game developer anchors to settle in or near startup zones, rather than to take their jobs and companies to other more developed parts of the country-specifically, to California, Texas, or Washington, which are the top three states of these high-paying and rapidly expanding jobs and development areas. This measure opens the state's excelsior jobs program to video game developers at a level that may help the state achieve critical mass in the area. It uses current measures of regional significance, for scientific R&D (20 new jobs), and current software development criteria of five net new jobs.
Fiscal implications
None, as the program is capped.
Effective date
Immediate.
