Title of bill

An act to amend the public health law, in relation to excluding patios and other outdoor areas on the premises of any entity licensed to operate a video lottery gaming facility from restrictions of the Clean Indoor Air act

Purpose

To allow VLT gaming facilities to create a patio or outdoor area that will be excluded from provisions of the Clean Indoor Air act if certain construction provisions are met.

Summary of provisions

Section 1 amends Section 1399-q of the public health law is amended to exclude patios and other outdoor areas on the premise of any entity licensed to operate a VLT gaming facility which are covered by a roof or other ceiling enclosure, provided that such covered patio must be clearly designated as a smoking area, and either is completely open on at least one side, or open on two or more sides with partial walls not more than fifty percent of the distance between the floor and ceiling. Jurisdiction in all matters pertaining to a smoking area on patios and other outdoor areas on the premises of any licensed VLT gaming facility in the state is vested exclusively in the state. It further provides that any local law or ordinance relating to these matters will be preempted upon the effective date of the law.

Section 2 is the effective date.

Justification

VLT gaming facilities may seek to build outdoor areas for their patrons to allow smoking. Current law expressly prohibits them from constructing these areas as they fall under the Clean Indoor Air act and people would not be able to smoke there. This legislation creates a tight limited exemption to give these facilities the option to build an outdoor structure where smoking would be allowable outdoors.
