BILL NUMBER:S4127
Title of bill
An act to amend chapter 326 of the laws of 2006, amending the tax law relating to authorizing the county of Hamilton to impose a county recording tax on obligations secured by mortgages on real property, in relation to extending the expiration thereof
Purpose
To extend, for another two years, the ability of Hamilton County to collect an additional mortgage recording tax.
Summary of provisions
The effective date of Chapter 326 of the Laws of 2006 -- which authorized Hamilton County to impose an additional mortgage recording tax -- is amended to extend the "sunset" date to December 1, 2017.
Existing law
Chapter 326 of 2006 is currently scheduled to expire on December 1, 2015.
Justification
In 2006, the Hamilton County Board of Supervisors requested legislation to impose an additional mortgage recording tax in order to help address its financial needs. This authorization was subsequently renewed in 2009 and 2012, and is currently scheduled to expire on December 1, 2015. Because these revenues are a necessary part of the County's financial plan, this bill would extend -- for another two years -- the authority of Hamilton County to impose this additional mortgage recording tax.
Fiscal implications
None to the State.
Local fiscal implications
Maintains the current revenue stream received by Hamilton County from the additional mortgage recording tax.
Effective date
Immediately.
