BILL NUMBER:S4242
Title of bill
An act to amend the environmental conservation law, in relation to the transportation of liquefied natural and petroleum gas, and to repeal certain provisions of such law relating thereto
Purpose
To amend the environmental conservation law to repeal paragraphs b and c of subdivision 2 and paragraph c of subdivision 3 of section 23-1709 of the environmental conservation law.
Summary of provisions
Section 1 - Repeals paragraphs b and c of subdivision 2 and paragraph c of subdivision 3 of section 23-1709 of the environmental conservation law and instead requires those that transport liquefied natural gas and petroleum gas to comply with all applicable federal and state laws and regulations and have a valid hazardous waste materials safety permit as issued by the Federal motor carrier safety administration.
Section 2 - Sets forth the effective date.
Justification
Liquefied natural gas (LNG) is a domestic alternative fuel for heavy duty trucking. LNG is becoming popular because it is cheaper and cleaner than diesel - and it is a domestic energy source. In 2015 the Department of Environmental Conservation promulgated regulations for the siting, building and operating of liquefied natural gas facilities and petroleum gas facilities, however, the department lacked the statutory authority to allow for the intrastate transportation of these fuels on New York's roads. This legislation would allow for such transportation and increase the environmental and economic benefits offered by this less expensive, cleaner burning fuel.
