Title of bill
An act to amend the vehicle and traffic law, in relation to including sani-vans and waste collection vehicles in the definition of "hazard vehicle" and to including hazard vehicles within certain speed restrictions
Purpose
This legislation would include sani-vans and waste collection vehicles in the definition of hazard vehicle and includes hazard vehicles within certain speed restrictions.
Summary of provisions
Section 117-a of the Vehicle and Traffic Law is amended to include sani-vans and waste collection vehicles in the definition of "hazard vehicle".
Subdivision (e) of section 1180 of the vehicle and traffic law is amended to include hazard vehicles displaying one or more amber lights under the requirement for drivers to reduce their speed when approaching such a vehicle.
Justification
In the span of just three months in late 2013, both a sanitation employee and a recycling employee in the Town of Oyster Bay were struck by vehicles while performing their duties.
Under current law, sanitation and recycling vehicles are not included under the protections provided to hazard vehicles in Section 117-a of the Vehicle and Traffic Law. Other vehicles currently protected include construction vehicles, highway maintenance vehicles and snow and ice removal vehicles.
This legislation would include sani-vans and waste collection vehicles in the definition of hazard vehicle. The bill also would require drivers who are approaching hazard vehicles displaying amber lights to reduce their speed.
A violation of these sections would be punishable as a traffic infraction.
