BILL NUMBER:S4310A
Title of bill
An act to amend the general municipal law, in relation to the abatement of public nuisances and demolition and removal of unsafe structures
Purpose or general idea of bill
To amend the Municipal Corporation Law to allow municipalities to pierce the corporate veil of shell corporations that abandon properties.
Summary of specific provisions
Section 1 amends § 78-b of Article 5 of the General Municipal Law by amending subsection 1 to make changes for abatement of public nuisances and demolition and demolition of nuisance properties.
Section 2 provides the effective date.
Justification
Many neglected and vacant properties are owned by corporations, limited liability companies, or limited liability partnership that abandon those properties when they become economically unavailable. These corporations, LLCs, and LLPs leave local governments (and local taxpayers)having to deal with the cost of abating nuisance conditions and demolishing unsafe buildings. State law should be amended to allow local governments to pierce the corporate veil of limited liability entities to hold their parent corporations and their individual owners responsible for nuisance abatement and demolition costs that exceed the property's value.
