BILL NUMBER:S4335
Title of bill
An act in relation to granting tier II retirement benefits in the New York city retirement system to Elisabeth Beavan
Purpose or general idea of bill
This legislation would grant Elisabeth Beavan Tier II Plan D status in the New York City Retirement System.
Summary of specific provisions
Section one authorizes the City of New York to allow Elisabeth Beavan, formerly Elisabeth Uellendah, to elect to be covered by the provisions of Plan D of Tier II of the New York City Employees' Retirement System. She was excluded from Plan D due to an administrative error. Ms. Beavan shall be entitled to the full rights and benefits associated with coverage under such section, by filing a request to that effect within one year of this bill being enacted. Section two includes the effective date and the fiscal note.
Justification
The paperwork to withdraw from Plan C and switch to Plan D was, for reasons not ascribable to her own negligence, not filed by Elisabeth Beavan. This legislation would allow Ms. Beavan to receive the retirement benefits she would have received had the proper paperwork been filed.
Prior legislative history

Fiscal implications for state and local governments
The annual retirement benefit paid to Ms. Beavan is expected to be $11,930 per year, retroactive to September 18, 2012 (age 62).
Effective date
This bill will take effect immediately.
