BILL NUMBER:S4379A

Title of bill

An act to amend the penal law, in relation to assault on a member of the military or reserves

Purpose or general idea of bill

This bill provides that it shall be a class C felony to commit an assault against a member of the military or reserves, when the accused committed said assault with the intention of preventing the member of the military or reserves from performing their lawful duty.

Summary of specific provisions

Sections One adds the definition of "member of the military or reserves" to the penal law.

Section Two provides that it shall be a class C felony to commit an assault against a member of the military or reserves, when the accused committed said assault with the intention of preventing the member from performing their lawful duty.

Section Three provides the effective date.

Existing law

It is currently a class C felony to commit such an assault against a peace officer, police officer, fireman, or emergency medical services professionals.

Justification

Like police officers, fireman, peace officers and emergency medical technicians, members of the military and reserve components serve an important role in the protection of the general public. While considered heroes to most, there are some who wish to harm these brave men and women. The members of our military and reserve components stand for freedom and are symbols of our democracy. Unfortunately, this has made them a target of the aggression of our enemies. This legislation will deter individuals from committing an assault against a member of the military or reserves and will ensure that those who do harm our service members are punished to the fullest extent of the law.
