BILL NUMBER:S4400

Title of bill

An act to amend the vehicle and traffic law, in relation to defining autocycles

Purpose

The purpose of this bill is to ensure that the vehicle and traffic law is updated to reflect the innovations in safety and stability in the design and manufacture of three-wheeled motor vehicles, hereby referred to as autocycles, which set them apart from motorcycles as currently defined.

Summary of provisions

This bill would amend the vehicle and traffic law by adding a new section 124 to read as follows:

124. Autocycle. A three-wheeled motor vehicle that has a steering wheel and seating that does not require the operator to straddle or sit astride and is manufactured to comply with federal safety requirements for motorcycles.

Notwithstanding any. administrative rule or regulation to the contrary, the provisions of subdivisions six, seven, nine, nine-a, and ten of section three hundred eighty-one of this chapter shall apply to autocycles and autocycle operators.

This act shall take effect immediately.

Justification

The autocycle is a three wheeled vehicle, which has many features similar to standard four wheeled vehicles including a steering wheel, seats and seat belts. Operation of the vehicle is, similar to a standard four wheel vehicle, yet currently, state law requires a motorcycle license to operate an autocycle. Colorado and Virginia have already passed laws to define autocycles as an independent class of vehicle, and other states are debating similar measures. In order to avoid precluding motor vehicle Manufacturers from manufacturing and bringing autocycles to market in New York State, we need to modernize current definitions in the Vehicle and Traffic Law to reflect technological advancements in the motor vehicle industry.
