Title of bill
An act to amend the penal law, in relation to murder in the first degree
Purpose or general idea of bill
To add the killing of a member of the military or reserves to the first degree murder statute
Summary of provisions
Section One makes technical changes to the first degree murder statute, in order to make the statute gender neutral. This section also adds the murder of a member of the military or reserves, who at the time of the murder was engaged in the course of performing their duties, to the first degree murder statute.
Section Two is the effective date.
Justification
The first degree murder statute already includes the killing of similarly situated individuals, such as police officers, peace officers, firefighters, emergency medical personnel, state correctional officers, witnesses to a crime, and judges. Adding military personnel to the statute is a logical measure.
