BILL NUMBER:S4521A
Title of bill
An act to amend the environmental conservation law, in relation to commercial food fish licenses
Purpose
Authorizes the Commissioner of the Department of Environmental Conservation to waive income eligibility requirements for veterans if the Commissioner is satisfied that all other requirements for a commercial food fishing license is met.
Summary of provisions
Section 1 of this bill authorizes the Commissioner of the DEC to waive the income eligibility requirements pursuant to section 13-0328 of the environmental conservation law for veteran applicants.
Section 2 of this bill provides that this act shall be effective immediately.
Justification
Individuals who have honorably served our country should not be prohibited from obtaining a commercial fisherman licenses due to income eligibility restrictions. Section 13-0328 of the Environmental Conservation Law contains a requirement that the applicant for a commercial food fishing license earn at least $20,000 per for three consecutive years within the fishing industry in order to be issued a license. Given the fact that members of the military who are returning home are unable to meet this requirement due to their service, it should be waived.
Last year the Senate passed legislation that would aid our veterans in finding jobs once they return from service, and New York State has in place a law that is standing between a veteran and his chosen post-service profession. The Senate should pass this legislation and ensure that the State does not unintentionally stand in the way of veterans finding employment.
