Title of bill

An act to amend the education law, in relation to private school agent's certificates

Summary of provisions

Section 1. Adds the definition of an "online education marketplace" within § 5001 of the education law, relating to licensed private career schools.

Section 2. Amends § 5004 of the education law, relating to a private school agent's certificate, to create a new exemption for an online education marketplace to offer advertising, marketing, or services in connection with the collection of tuition and fees from requirements relating to obtaining a private school agent's certificate. The section also sets standards for an "online education marketplace" to comply with before qualifying for the exemption.

Justification

This legislation would promote access to learning through the online education place model, which increases educational opportunity for the citizens of New York State while supporting emerging technologies and businesses. It creates a balanced regulatory framework within which the online education marketplace model can flourish without jeopardizing the protections provided to students today. Online education marketplaces are evolving businesses that help to drive growth in the technology and education sectors. They have created new jobs and offered new services to education consumers in New York State and will continue to do so. These businesses allow prospective students to access all manner of learning, some of which takes place at regulated schools, and some of which does not. While technology touches many regulated marketplaces, such as that of proprietary schools, websites and other web based services are not typically considered within the regulatory purview of the State Education Department. This legislation would therefore create sensible criteria by which online education marketplaces would be exempt from requirements relating to a private school agent's certificate for marketing, advertising, or services in connection wi th the collection of tuition and fees, while preserving student protections, and allowing a new technology business model to grow in New York State.
