BILL NUMBER:S4764
Title of bill
An act to amend the public health law, the labor law and the administrative code of the city of New York, in relation to providing notice to restaurants of any regulation changes
Purpose or general idea of bill
To give restaurants sufficient notice to make changes when public health regulations are amended
Summary of specific provisions
Section 1- amends section 1352 of public health law to add-
2. That any regulatory body that creates or enforces public health law will-
a. notify establishments in writing of changes
b. give 60 days after the notices is sent before enforcing changes
Section 2. Also adds these regulations to labor law by adding section 383
Section 3. Also adds these regulations to the New York city administrative code by adding section 17-324.1
Justification
Under current law, state, city and local regulatory bodies have the ability to impose and enforce new regulations on eating establishments without providing sufficient notice of the changes to said establishments and allowing adequate time for compliance. While maintaining proper standards to protect public health is and should be a top priority for government, this can be accomplished without exposing small businesses to unfair, arbitrary fines aimed solely at generating revenue. This bill allows regulatory agencies to hold eating establishments accountable for the health and well-being of their customers while protecting the establishments from being unwittingly subjected to costly fines that infringe on their ability to conduct business.
