BILL NUMBER:S4813
Title of bill
An act to amend the environmental conservation law, in relation to the issuance of free hunting, fishing and trapping licenses to members of the Seneca nation
Purpose
The purpose of this legislation is provide for the issuance of free hunting, fishing and trapping licenses to members of the Seneca Nation who reside in the state, whether on or off the Seneca Nation's territory.
Summary of provisions
Section one and section two add new sections to Section 11-0703 of the environmental conservation law and section 11-0715 of the environmental conservation law to clarify that free hunting, fishing and trapping licenses shall be made available to enrolled members of the Seneca Nation of Indians who reside within the State of New York, either on or off any Seneca Nation Indian Reservation. Section three provides an enactment date.
Justification
Pursuant to historical agreements with the Seneca Nation of Indians following the construction of the Kinzua Dam and the New York State Thruway, New York State is obligated to provide free hunting, fishing and trapping licenses to members of the Seneca Nation of Indians. At some point during the time that has passed since the 1970s, the long-standing agreement the State had with the Seneca Nation to provide all enrolled members with free hunting, fishing and trapping licenses regardless of residency on or off Indian territory, became more restricted to just those members residing on Indian territory. Currently, the New York State Department of Environmental Conservation's policy is to restrict these free licenses to only those members of the Seneca Nation who reside on the Indian territories.
This legislation will ensure that the original intent of the terms of the agreements with the Seneca Nation relating to free hunting, fishing and trapping licenses for all members are implemented. This legislation acknowledges the unique, historical, and vital role the Seneca Nation of Indians has played in New York's history and recognizes their rights as a sovereign Indian nation.
