BILL NUMBER:S4817B

Title of bill

An act to amend the town law and the public officers law, in relation to authorizing the town justice of the town of Lewis in Lewis County to be a nonresident of the town of Lewis under certain circumstances

Purpose

This bill allows an individual, not an elector of the town of Lewis, Lewis county to serve the functions of town justice in that township. More specifically, the town justice of the town of Osceola, Lewis county, a resident and elector of that township, may perform the functions of town justice in the town of Lewis, Lewis county.

Summary of provisions

Section 1 amends section 23 of the town law by adding a new subdivision 29. This new subdivision allows a person not an elector of Lewis, Lewis county to serve as the town justice, provided that the town justice of Osceola, Lewis county is an elector of that township.

Section 2 amends section 3 of the public officers law by adding a new subdivision 64. This new subdivision removes the requirement that the person serving as town justice in the town of Lewis, Lewis county must be a resident of that municipality.

Existing law

Current town law does not allow for a person who is not an elector of the town of Lewis, Lewis county to serve as the town justice of that town. Current public officers law does not allow a person who is not a resident of Lewis, Lewis county to serve as the town justice of that town.

Justification

Lewis county is a remote region. With a sparse population, administrating town governments can be a challenge. This challenge is amplified when offices require special qualifications. Town justice is a governmental position that rightfully requires specific and strenuous educational and occupational qualifications. Town justice is also an important position that is necessary to keep governments running smoothly.

The town of Lewis currently has no acting town justice. This legislation aims to give the town of Lewis an acting town justice by allowing the town justice of Osceola to perform the functions of the office. This change in law will keep the court system of the town of Lewis operating efficiently.
