BILL NUMBER:S4923

Title of bill

An act to amend the tax law, in relation to exempting certain prekinder- garten special education programs from the metropolitan commuter trans- portation mobility tax

Purpose

To add institutions that provide services to disabled children of preschool age (section 4410 agencies) to the list of other schools and agencies that are exempt from the metropolitan commuter transportation tax.

Summary of provisions

This bill would amend Section 800 (b) (4) of the tax law to include schools that are approved pursuant to article 85 or 89 of the education law to serve students with disabilities of preschool age to those insti- tutions that are now exempt from the MTA payroll tax.

Justification

At a time when 4410 providers are facing reimbursement challenges, coupled with increased labor and other costs, the MTA payroll tax is a very weighty encumbrance. This legislation would add these agencies to other similar schools and providers who have already been given such an exemption from the tax.
