BILL NUMBER:S4930
Title of bill
An act to amend the general business law, in relation to training requirements
Purpose
To allow federal law enforcement officers to qualify for a waiver from the security guard training requirements.
Summary of provisions
Section 1. Adds a new paragraph h to subdivision 4 of section 89-n, to allow federal law enforcement officers who have been retired for less than ten years, and who have the powers of a peace officer pursuant to article 2 of the criminal procedure law to be exempt from the requirement that security guards must complete training programs given and administered by security guard training schools.
Section 2. Provides the effective date.
Justification
Many individuals classified as peace officers are exempt from certain training requirements to become security guards, such as police officers. However, although federal law enforcement officers, including U.S. Probation Officers and FBI, DEA, and Secret Service agents, have undergone rigorous training and have the powers of peace officers under the New York criminal procedure law, they are not eligible for a waiver of the training requirements to become security guards. Additionally, these officers often have years of experience and are seeking secondary employment as a way to supplement their income, as they do not receive overtime benefits. submitted in accordance with Assembly Rule III, Section 1(e).
This law would allow such federal law enforcement officers to be eligible for a training waiver, with the exception of federal law enforcement officers retired for more than ten years, who must show satisfactory completion of an 8 hour training course, and must provide proof of a 47 hour firearms training course approved by the commissioner. These requirements are already in place for former police officers, as well as individuals classified as peace officers who are eligible for the waiver.
