BILL NUMBER:S5005
Title of bill
An act to amend the environmental conservation law, in relation to extending the authority of the department of environmental conservation to manage lobster
Purpose of the Bill:
The purpose of this bill is to extend the authority of the Department of Environmental Conservation (DEC) to manage lobsters.
Summary of Provisions:
Section 1 of this bill amends Environmental Conservation Law (ECL) 13-0329(16) to extend, until December 31, 2018, DEC's authority to adopt regulations to implement conservation measures that affect take, possession and landings of lobsters (Homarus americanus) in Atlantic States Marine Fisheries Commission (ASMFC) Areas One, Two, Three, Four, Five and Outer Cape , consistent with the recommendations of the respective Area's Lobster Conservation Management Teams as required by the Interstate Fishery Management Plan (FMP) for American Lobster adopted by ASMFC.
Section 2 of this bill provides that the bill shall take effect immediately.
Existing Law:
ECL § 13-0329(16) grants DEC regulatory authority, until December 31, 2015, for lobsters in ASMFC Areas One, Two, Three, Four, Five and Outer Cape.
Prior Legislative History:
DEC's regulatory authority to manage lobsters in ASMFC Areas One, Two, Three, Four, Five and Outer Cape was last extended by Chapter 439 of the Laws of 2011.
Statement in Support:
DEC's regulatory authority for lobster is necessary in order to preserve the current regulatory program. Failure to extend the existing regulatory authority by December 31, 2015 would result in the loss of regulatory protection for lobsters in Areas One, Two, Three, Four, Five and Outer Cape. Regulatory authority is critical for New York to maintain compliance with the ASMFC FMP for American Lobster. Regulatory authority provides the mechanism necessary to react rapidly to the ever-changing FMP in a timely fashion. Moreover, failure to make necessary regulatory changes as may be required by the FMP could result in the closure of New York's lobster fishery.
Budget implications:
None.
Local impact:
This bill would have no impact on local governments.
Effective Date:
This act shall take effect immediately.
