BILL NUMBER:S5021

Title of bill

An act to amend the education law, in relation to the guidelines and regulations of the teacher and principal evaluation system

Purpose

This legislation would extend the implementation date of the new regulations and guidelines from the Commissioner of the State Education department for an altered statewide annual teacher and principal evaluation system.

Summary of provisions

Section 1 of subpart E of part EE and subdivision 11 of section 3012-d of the education as added as part of Chapter 56 of the laws of 2015 are amended to extend the implementation date of the new regulations and guidelines from the Commissioner of the State Education department for an altered statewide annual teacher and principal evaluation system.

These new requirements will set by the commissioner by January 31, 2017 instead of June 30, 2015 and will apply to all plans beginning in the 2017-18 school year. School districts will be required to adopt a new plan by June 15, 2017 instead of November 15, 2015 or risk losing any increase in state aid.

Justification

The current effective date of June 30, 2015 is simply unrealistic when you combine all the obstacles currently in the way of a successful process. The obstacles include the lack of a current SED commissioner, the learning curve of newly confirmed members to the Board of Regents, the confusion amongst the Board relative to the adopted language, and growing opposition from both parents and education professionals.

An effective date of January 31, 2017 will allow ample time for sufficient public comment and SED review. It would eliminate a rushed product that will lack proper deliberation and transparency.
