BILL NUMBER:S5024
Title of bill
An act authorizing the Saratoga County Water Authority, County of Saratoga to effectuate a lot line adjustment involving a portion of reforested lands in the town of Moreau
Purpose
To allow the Saratoga County Water Authority and the County of Saratoga to complete an equitable transfer of real property for the water authority to make improvements and upgrades to its water treatment plant.
Summary of provisions
Section 1 provides the Saratoga County Water Authority in the county of Saratoga, acting by and through the county board of supervisors, to effectuate a lot line adjustment involving a portion of reforested lands described in section two.
Section 2 is the updated real property deed description to correct a previous deed between the Saratoga County Water Authority and the County of Saratoga.
Section 3 states the effective date and the law the bill is amending.
Justification
In 2008, the county of Saratoga conveyed to the Saratoga County Water Authority (SCWA) a 21.86 acre parcel of county owned reforested land for the construction of a water treatment plant. Because the county was conveying the reforested parcel to SCWA for a purpose other than reforestation or one authorized by County Law § 219, the county sought and obtained home rule legislation under Chapter 4.39 of the Laws of the 2006. SCWA subsequently constructed the water treatment plant and all necessary appurtenances.
Currently, in the course of designing needed improvements and upgrades to its water treatment plant, SCWA discovered that portions of the water treatment facility, as constructed, enter onto adjoining reforested lands of the county. In order to remedy SCWA's entry onto the county's reforested lands, the county and SCWA have proposed an equitable transfer of real property between the two entities: (1) the westerly boundary of SCWA's parcel is expanded by 5 acres onto land currently owned by the county and (2) the southern boundary of SCWA's parcel is reduced by 5 acres, with the property restored to county ownership and re-designated as county reforested land.
