BILL NUMBER:S5037

Title of bill

An act to amend chapter 381 of the laws of 2012 amending the education law relating to the licensure of private proprietary schools, in relation to the effectiveness of certain provisions of such chapter

Purpose

This bill would extend for an additional three years, the provision that allows proprietary schools to operate under a candidacy status for a period of one year.

Summary of provisions

The bill would amend section 12 of chapter 381 of the laws of 2012 to extend for an additional three years the law that allows proprietary schools to operate under a candidacy status for a period of one year, with a possible six month extension, while its application for licensure is considered by the State Education Department (SED).

Justification

The Bureau of Proprietary School Supervision (BPSS) oversees and monitors non-degree granting proprietary schools in New York State. The Bureau is responsible for ensuring that the overall educational quality of the programs offered will provide students with the necessary skills to secure meaningful employment and for protecting students' financial interests while attending proprietary schools. Chapter 381 of the laws of 2012 allows proprietary schools to operate under a candidacy status for a period of one year while its application for licensure is considered by SED. This one year candidacy period allows the SED to full examine a proprietary school's capacity to provide a quality education to its students and its ability to comply with education law and the Commissioner's regulations before licensure. This bill would ensure that this process would continue
