BILL NUMBER:S5062A
Title of bill
An act to authorize Angelo Gigliotti to take the competitive civil service examination and be placed on the eligible list for appointment as a full-time police officer for the city of Little Falls, county of Herkimer
Purpose
To allow Officer Gigliotti, who is over the age of thirty-five, to take the competitive civil service exam and be eligible for placement on an eligible list for appointment as a full-time police officer, contingent upon his exam score and ability to meet the physical fitness requirements of the position.
Summary of provisions
Section 1 provides eligibility for taking the civil service exam for the position of full-time police officer, contingent upon his exam score. Section 2 subjects Officer Gigliotti to the merit and fitness provisions for this position. Section 3 provides for an immediate effective date.
Existing law
Section 58 of Civil Service Law requires applicants for the position of full-time police officer to be no older than thirty-five years of age.
Justification
Recruiting and retaining well-qualified full-time police officers is challenging for small rural police departments. At the request of the mayor of the city of Little Falls and the chief of police, this bill would address this issue by allowing a part-time police officer of the city of Little Falls Police Department to be eligible for full-time status. While age restrictions certainly have practical value, they do not always reflect the ability of some candidates to perform full-time police duties. According to the chief of police, Officer Gigliotti has been a part-time officer since 2010 and he is perfectly competent to perform the duties required of a full-time police officer, rating his skills as "exemplary"-even outperforming some of his younger classmates at the police academy-and graduated with an average of ninety-one.
