BILL NUMBER:S5070
Title of bill
An act to amend the alcoholic beverage control law, in relation to a license to sell liquor at retail for consumption on certain premises
Purpose of the bill
This legislation would allow for an exemption to the "200 Foot Rule" under the State's Alcoholic Beverage Control Law to allow for Perillo Hospitality, LLC, doing business as Salumeria Belsito at 1368 Hertel Avenue in Buffalo, to apply for an on-premise liquor license from the New York State Liquor Authority.
Summary of specific provisions
§ 1- Amends subdivision 7 of § 64 of the Alcoholic Beverage Control Law by adding a new paragraph (e-7).
§ 2- Effective date.
Justification
Section 64 of New York State's Alcoholic Beverage Control Law states that, "No retail license for on-premises consumption shall be granted for any premises which shall be (a) on the same street or avenue and within two hundred feet of a building occupied exclusively as a school, church, synagogue or other place of worship" often referred to as the "200 Foot Rule". In very specific instances where the affected school, church, synagogue or other place of worship is not in opposition to an application for an on-premise license which would otherwise not be allowed, the legislature, with written proof of the affected entity's acquiescence, allows for an exemption from the "200 Foot Rule."
