BILL NUMBER:S5152
Title of bill
An act to authorize Steven M. Carlson to apply for retroactive membership in the New York state and local employees' retirement system on the basis of prior seasonal employment by the department of parks and recreation of the city of New York
Purpose
To allow Steven Carlson to apply for membership in the New York City employees' retirement system and retroactive membership in the New York state and local employees' retirement system. This bill would allow Mr. Carlson to be eligible to apply for retroactive membership upon completion of a timely and acceptable application to the state comptroller.
Summary of provisions
Section 1 authorizes Steven M. Carlson to apply for and receive membership in the New York City employees' retirement system and retroactive membership in the New York state and local employees' retirement system, beginning June 19, 1968, pursuant to section 645 of retirement and social security law, provided that he submit a written application to the state comptroller within one year of the effective date of this act. Section 2 provides the effective date.
Existing law
In recognition of one's total public service, section 645 of retirement and social security law allows for continuity of service credit for former state employees who were members of a public retirement system and who later returned to public service. Legislation was passed in 1992 and 1996 allowing retroactive membership in the city's retirement system for part-time employees. However, Mr. Carlson was ineligible due to his transfer into the state retirement system in 1986, prior to the enactment of such legislation.
Justification
Mr. Carlson worked part-time for the department of parks and recreation of New York City from 1968 to 1972. This marked the beginning of a long career of service to the city and state, retiring from the state department of health in 2013. This legislation would allow him to apply for retroactive membership in the state employees' retirement system to 1968, provided he submit a timely and acceptable application to the office of the state comptroller.
