BILL NUMBER:S5200A
Title of bill
An act to amend the county law, in relation to communication service surcharges applied to Oswego county
Purpose
To authorize the Oswego County legislature to impose wireless surcharge in Oswego County
Summary of provisions
Section 1 amends the county law by adding a new section 309 establishing a wireless surcharge in an amount not to exceed $0.30 per month on wireless communications service in Oswego County.
Section 2 provides the effective date.
Existing law
§ 303 of the county law establishes surcharges for system costs.
§ 325(16) of the county law defines eligible wireless 911 service costs as costs eligible for reimbursement and shall include the actual costs incurred by the locality related to the design, installation, operation, or maintenance of a system to provide enhanced wireless 911 service, including, but not limited to, hardware, software, consultants, financing and other acquisition costs.
Justification
The Oswego County Legislature has requested the authority to establish a 911 wireless surcharge. The county operates an enhanced 911 center and is the single answering point for all 911 calls in Oswego County. Due to constant technological changes and advancement, the county's E-911 equipment and radio system requires improvements on a yearly basis. While the county already has a land line surcharge in place, the prevalence of cell phones has grown dramatically since the inception of E-911 to the point where many residences no longer utilize a land line. This change has resulted in a decrease in land line revenues while, at the same time, costs associated with the ability to process a wireless call and call volume originating from cell phones has increased. A wireless surcharge $0.30 per month would greatly help the Oswego's E-911 Center continue to improve its services to county residents and treat persons with only a cell number as equitable as those with a only a land line. This bill is in the county's best interest and as such, the enactment of this bill is essential.
