BILL NUMBER:S5259
Title of bill
An act to authorize the commissioner of general services to transfer and convey certain unappropriated state land to the village of Otisville
Purpose
To authorize the Commissioner of the Office of General Services (OGS) to convey to the Village of Otisville property adjacent to the Otisville Firehouse.
Summary of provisions
Section 1:Authorizes the Commissioner of OGS to convey property to the Village of Otisville.
Section 2:Provides a description of the parcel to be conveyed.
Section 3:Provides that the description in section 2 is not intended to be a legal description, but is intended to identify the parcel to be conveyed. Allows the Village of Otisville to submit to the Commissioner of OGS an accurate survey and description of the lands to be conveyed.
Section 4:Provides that OGS shall not transfer or convey the parcel unless an application is made by the Village within one year after the effective date of this act.
Section 5:Provides that the land described in this act shall be used exclusively for the Village of Otisville's fire department. In the event the premises are not used for such purposes, ownership shall revert to the State of New York.
Section 6:Effective date.
Justification
The Village of Otisville is seeking a small parcel of land located next to the Otisville Firehouse to be conveyed to the Village. The Village has used and maintained this parcel since approximately 1960. The Department of Corrections and Community Supervision owns the property and has agreed to relinquish its jurisdiction to the Office of General Services so the Office may convey the property to the Village. However, legislative authorization is required to allow the conveyance.
