BILL NUMBER:S5284
Title of bill
An act to amend the tax law, in relation to recording tax imposed by the county of Rockland
Purpose
To allow the County of Rockland to collect the mortgage recording tax for a full three years as provided for by state law.
Summary of provisions
Section 1 amends subdivisions 6 of sections 253-f of the tax law, as added by chapter 193 of the laws of 2003 to be three years from the date of imposition instead of enactment.
Section 2 is the effective date.
Justification
This legislation introduced at the request of the County would amend Tax law sections 253-f(6) which dictates that the law expires three years from the date of its enactment, which would be from December 15, 2014 to December 15, 2017, despite the fact that the County of Rockland's local law states the three year window is from the date of its imposition, which would be from February 1, 2015 to January 31, 2018.
Due to this it creates a gap in the County's authority to collect the mortgage recording tax for a full three years as originally contem- plated.
The County has stated that each time the law gets renewed by the County legislature for a term of three years, the time line for the law essen- tially rolls back on itself, thereby shortening the three year time frame to less than three years.
