BILL NUMBER:S5320
Title of bill
An act to amend the executive law and the agriculture and markets law, in relation to police training regarding animal cruelty and protection laws
Purpose
The purpose of this bill is to improve the education and training of police officers in animal cruelty and protection laws and make information about the laws readily available to police and prosecu- tors
Summary of provisions
Section one amends paragraph (k) of subdivision 1 of section 840 of the executive law to include the Department of Agriculture and Markets in development of police training policies and procedures by the Municipal Police Training Council related to enforcement of animal cruelty and protection laws. The Council would also make provisions for education and training in such policies and procedures.
Section two amends section 837 of the executive law by adding a new subdivision 20 that would require the Division of Criminal Justice Services to assist the Department of Agriculture and Markets in develop- ing information about animal cruelty and protection laws to be used by law enforcement.
Section three amends section 16 of the agriculture and markets law by adding a new subdivision 48 to make available both written and electron- ic information about animal cruelty and protection laws for use by police agencies, officers, and district attorneys and coordinate with the Division of Criminal Justice Services to develop training for munic- ipal police officers and district attorneys.
Section four provides for the effective date.
Justification
Prevention, investigation and enforcement of animal abuse, cruelty and neglect have become a more substantial part of the work of police officers. Although existing executive law for training municipal police officers includes language regarding the development of policies and procedures pursuant to agricultural and markets animal protection laws, there is a need to make it clear that education and training in these laws is a priority and that the training be developed with input from the Department of Agriculture and Markets. This bill would update the executive law to achieve those goals.
In addition, because there have been reports that some police and prose- cutors may not be familiar with the agriculture and markets law, this bill would have the Department, in coordination with Division of Crimi- nal Justice Services, develop information about animal cruelty and protection laws to enhance both the training and enforcement of these laws. This information would be made readily available to police agen-
cies and prosecutors to assist their daily work in protecting animals from abuse and cruel treatment.
