BILL NUMBER:S5341
Title of bill
An act to amend the alcoholic beverage control law, in relation to cider sold at retail for consumption
Purpose
To create parity in the licenses of the farm based beverage sector for on-premises consumption.
Summary of provisions
Section 1: Amends paragraphs h, i, and j of subdivision 2 of section 58-c of the alcoholic beverage control law.
Section 2: Establishes the effective date.
Justification
Farm-based beverage sectors have shared interests yet there is a lack of parity among the farm-based licenses. Cross-promotion is vital to the success of these businesses as well as to the value they add to the agricultural sector. Current law permits farm wineries & farm breweries to sell cider by the glass at their premises thereby cross-promoting New York cider. But under a farm cidery license, the licensee cannot reci- procate sales of New York wine, beer or spirits. Cross-promotion oppor- tunities by farm cidery licensees are, thus, prohibited. Parity in these provisions is necessary to continue to promote New York farm sector beverages and to support economic growth for New York State agriculture.
