BILL NUMBER:S5351A
Title of bill
An act to amend chapter 85 of the laws of 1934, creating the Chautauqua utility district, in relation to the qualifications of the commissioners thereof
Purpose
This bill provides that commissioners of the Chautauqua utility district need only be an elector of the town of Chautauqua, and not such district.
Summary of provisions
Section 1. Provides that commissioners must be electors of the Town of Chautauqua in order to qualify to be on the board of commissioners of the district.
Section 2. Provides the effective date.
Justification
This bill has been requested by the Chautauqua Utility District Board of Commissioners. The Chautauqua Utility District serves the Chautauqua Institution in Chautauqua County, New York. Originally created in 1934, the district has found it increasingly difficult to find people willing to serve as commissioners who possess the required skills needed for a commissioner who also meet the residency qualifications of the original statute.
This bill expands slightly the geographic area in which commissioners may reside. The bill requires that commissioners be electors of the Town of Chautauqua which is immediately adjacent to and surrounding Chautauqua Institution.
The bill further removes requirements that commissioners be an owner or lessee of taxable real property within the district.
