BILL NUMBER:S5380

Title of bill

An act to authorize the commissioner of general services to transfer and convey certain state property to the town of Fallsburg

Purpose

To authorize the Commissioner of the Office of General Services (OGS) to convey the Sullivan Annex at the Sullivan Correctional Facility to the Town of Fallsburg

Summary of provisions

Section 1: Authorizes the Commissioner of OGS to convey state owned land known as the Sullivan Annex located at the Sullivan Correctional Facility to the Town of Fallsburg.

Section 2: Provides a description of the land to be conveyed.

Section 3: Provides that the description in section 2 is not intended to be a legal description, but is intended to identify the lands to be conveyed. Requires the Town of Fallsburg to submit to the Commissioner of OGS an accurate survey and description of the lands to be conveyed.

Section 4: States that this authorization shall be subject to the condition precedent that such conveyance shall not impair or result in any diminution of the obligations to holders of any bonds which financed, refinanced, or are secured by correctional facilities, and shall not adversely affect any exemption of interest on such bonds from federal income tax.

Section 5: States that the land described in this act shall be used exclusively for the Town of Fallsburg. In the event the premises are not used for such purposes, it shall revert to the State of New York.

Section 6: States that OGS shall not transfer or convey the lands unless an application is made by the Town within one year after the effective date of this act.

Section 7: Effective date.

Justification

The Town of Fallsburg is seeking the Sullivan Annex at the Sullivan Correctional Facility to be conveyed to the Town. The Correctional Facility has not used the Annex in several years. The Department of Corrections and Community Supervision owns the property and has agreed to relinquish its jurisdiction to the Office of General Services so the Office may convey the property to the Town. However, legislative authorization is required to allow the conveyance.
