Title of bill

An act to amend the alcoholic beverage control law, in relation to terms of sale of alcoholic beverages

Purpose

This bill will provide manufacturers and wholesalers greater flexibility in developing payment plans with retailers.

Summary of provisions

Section 1. Amends paragraph a of subdivision 1 of section 101-aa of the alcoholic beverage control law to define credit period as a period beginning on the date alcoholic beverages are delivered and ending sixty days thereafter.

Existing law

Currently, credit period is defined as a period beginning on the date alcoholic beverages are delivered and ending thirty days thereafter.

Justification

The current thirty-day credit period that manufacturers and wholesalers are required to limit retailers to is onerously short. A sixty-day credit period is more appropriate.
