BILL NUMBER:S5465
Title of bill
An act to grant Julius Diamond eligibility for senior citizen rent increase exemption at his previously frozen rent amount
Purpose
This bill will restore SCRIE benefits to Julius Diamond, who had an increase in his annual income one month before SCRIE increased the maximum income allowed for benefits.
Summary of provisions
Section 1 states that Julius Diamond shall have his senior citizen rent increase exemption (SCRIE) returned to the rate he previously received prior to June of 2014. Section 1 also states that Mr. Diamond's land- lord, Pickman Realty Group, shall be entitled to a reimbursement for the rent arrears that are owed to them due to Mr. Diamond's inability to pay.
Section 2 states that all costs associated with the implementation of this act shall be borne by the New York City department of finance.
Section 3 sets the date that this act shall take effect.
Justification
Julius Diamond is a 103-year-old citizen who needs a fixed rent in order to afford living and thus survive. Mr. Diamond was denied SCRIE in November of 2013 after his income increased, exceeding the maximum cap for SCRIE. After the SCRIE maximum changed, Mr. Diamond reapplied, he was given a new rent that was much higher than the old level he qualified for.
This legislation would give Mr. Diamond back the benefits he had before income level changed, given that he still remains SCRIE eligible. It would also satisfy all arrears that were incurred due to his inability to pay.
Legislative history
This is a new bill.
Fiscal implications
This cost of this bill would be equivalent to the arrears Mr. Diamond owed his landlord.
