BILL NUMBER:S5514
Title of bill
An act to authorize the transfer of certain pumping stations to the city of New York
Purpose or general idea of bill
This bill authorizes transfer of two pumping stations that service 75 homes within Waterside Estates development in Whitestone in the County of Queens to the city of New York.
Summary of provisions
Section one states that Waterside Estates at Cresthaven Home Owners Association, Inc. is authorized to transfer the rights, titles and interests for the pumping stations located at 150-102 Powell's Cove Boulevard, Whitestone, BB 4507, Lot 37 and 150-113 Powell's Cove Boule- vard, Whitestone, BB 4487, Lot 90 to the city of New York.
This section further states that the city of New York shall accept such transfer and authorize the department of environmental protection to supervise and maintain the aforementioned pumping stations in the inter- est of the residents of the Waterside Estates and the city of New York.
Section four of the bill sets forth an immediate effective date.
Justification
In 1998, the New York State Attorney General accepted an offering plan sponsored by Waterside Estates at Cresthaven, LLC to develop a fifteen acre site creating one hundred single family homes and a homeowners' association. The plan required building two "pumping stations" to service 75 of the 100 homes. During the development, 2 sanitary (sewer) pumping stations were required to be built to allow the properties to connect to the city sewer system.
Maintenance and servicing of these stations is an undue burden on the homeowners of Waterside Estates who possess neither the expertise nor financial ability to continue to maintain them.
Given that the city is in the best position to maintain and service these pumping stations, it is in the public's interest that these pump- ing stations be transferred to the city. This transfer is also reason- able given the fact that the city maintains 2 other pumping stations located only blocks away from the pumping stations servicing Waterside Estates along Powell's Cove Boulevard.
