BILL NUMBER:S5532
Title of bill
An act to amend the education law, in relation to relocation of a char- ter school
Purpose or general idea of bill
The purpose of this bill is to provide that if a New York City based charter school relocates to a different community education council district, the proposed new community education council district shall hold a public hearing to solicit comments from the community which will be affected by the relocation.
Summary of specific provisions
Section 1 of the bill amends subdivision 1 of section 2857 of the educa- tion law to add community education council districts in a city with a population of one million or more to the list of entities required to hold a public hearing in the event of the relocation of a charter school.
Section 2 of the bill provides that it shall take effect on the nineti- eth day after it shall have become a law.
Justification
Under existing law, school districts (including the New York City Department of Education) are required to hold public hearings regarding the application for new charter schools. The hearings must be held in the community school district specified in the charter school's applica- tion to the SUNY Board of Trustees. In practice, if a proposed charter school's application is revised to place the charter school in a differ- ent location, another hearing is required only if the school will be located in a different school district.
In New York City, however, different community school districts, even within the same borough, can be markedly different in terms of demo- graphic make-up and educational needs. If a proposed charter school in New York City revises its application to move the location of the school to the boundaries of a different community education council district within the City, it should be required to hold a public hearing in the community in which it is proposing to move.
