BILL NUMBER:S5537
Title of bill
An act to amend the real property tax law, in relation to penalties and interest payments in towns of Dutchess county
Purpose
This bill would provide clarification for collection officers in Dutch- ess County that if the final date of collection of taxes falls on a Saturday, Sunday or a holiday, an extension of the collection of taxes shall automatically be on the first business day that follows.
Summary of provisions
Section one amends Section 1504 of the real property tax to provide clarification that if the final date of collection of taxes falls on a Saturday, Sunday or a holiday, an extension of the collection of taxes shall automatically be on the first business day that follows.
Section two sets an immediate effective date.
Justification
Section 925a of the Real Property Law requires collection officers to accept the payment of taxes without penalty on the first business day that follows a final date for the collection of taxes that falls on a Saturday, Sunday or holiday. However, Section 1504 of the real property tax law which impacts only the towns in Dutchess County does not contain this provision. As both sections notwithstand the provisions of any general or special law to the contrary, it has caused confusion in at least one municipality in the county of Dutchess.
This bill provides clarification by amending Section 1504 to reflect the general practice of municipalities throughout Dutchess County which has been to accept taxes without penalty on the next business day when the final date for collection of taxes falls on a weekend or a holiday.
This practice serves not only as a matter of convenience for the taxpay- er, but for the municipalities as well.
