BILL NUMBER:S5539

Title of bill

An act to authorize the county of Greene to offer an optional twenty year retirement plan to deputy sheriff John Del Vecchio

Purpose

This bill would authorize the County of Greene to offer an optional twenty year retirement plan to Deputy Sheriff John Del Vecchio.

Summary of provisions

Section one of this legislation authorizes the County of Greene to offer enrollment in the "Special Retirement Plan for Sheriff, Undersheriff and Deputy Sheriffs Engaged in Law Enforcement Activities" to Deputy Sheriff John Del Vecchio.

Section two of this legislation states that all employer service costs associated with implementing this act shall be borne by the County of Greene.

Section three of this legislation provides for an immediate effective date.

Justification

By Resolution No. 248-98, the Greene County Legislature adopted to offer an optional retirement plan for Sheriff, Undersheriff and Deputy Sher- iffs Engaged in Law Enforcement Activities. It was subsequently deter- mined that part-time and per diem Deputy Sheriffs were not properly and timely enrolled in this plan and as a result, Greene County was granted State Legislation providing for their enrollment.

Recently, it has come to the attention of the Greene County Legislature that, through no fault of his own, one Greene County Deputy Sheriff, John Del Vecchio, was never properly and timely enrolled in the plan. As the only law enforcement Deputy Sheriff currently in the Greene County Deputies Union, Local 0927 employed by Greene County, who is not currently covered by this special retirement plan, the Greene County Legislature has requested legislation to remedy this situation.

Legislative history

This is a new bill.

Fiscal implications

It is important to note that there will be no fiscal implications for the State. Greene County has acknowledged it will assume the additional

costs associated with implementing this act as part of its Home Rule request to the State Legislature.

If this bill is enacted and Deputy Sheriff Del Vecchio becomes covered under the provisions of Section 552, it is anticipated that there will be an increase of approximately $6,900 in the annual contributions of Greene County for the fiscal year ending March 31, 2016. In future years, this cost will vary. In addition to the annual contributions, there will be an immediate past service cost of approximately $40,600 which would be borne by Greene County.

This estimate, dated May 12, 2015, and intended for use only during the 2015 Legislative Session, is Fiscal Note No. 2015-108, prepared by the Actuary for the New York State and Local Employees Retirement System.

Effective date

This act shall take effect immediately.
