Title of bill
An act to amend the insurance law, in relation to directing the New York state health care quality and cost containment commission to study and report upon the impact of requiring that certain health insurance plans provide coverage for treatment of mitochondrial disease
Purpose
Directs the health care quality and cost containment commission to study and report upon the impact of requiring that certain health insurance plans provide coverage for treatment of mitochondrial disease.
Summary of provisions
Section 1. Amends section 213 of the insurance law by adding a new subdivision (e)
Section 3. Establishes the effective date.
Justification
It is estimated that more than 1 in 4000 people suffer from mitochondrial disease. Patients with mitochondrial disease have mitochondria that cannot efficiently turn sugar and oxygen into energy. This disease has the potential to impact every organ of the body and is marked by highly variable symptoms. Some patients have had success in mitigating symptoms of the disease through the use of certain vitamins and supplements which are not currently covered by insurance companies. In particular, children who are born with this disease need to obtain necessary treatment which is critical to prevent cognitive and learning disabilities later in life. When they are financially able to, patients spend hundreds of dollars on their own and have had positive outcomes which minimizes costs to the health care system.
This bill will be the first step in addressing a solution to this issue. Although mitochondrial disease indicates small in many ways, it is large in cost and quality of life for those affected.
