BILL NUMBER:S5574

Title of bill

An act to amend the administrative code of the city of New York, in relation to the limitation on parking of mobile homes and trailers on residential streets

Purpose or general idea of bill

To limit the parking of mobile homes and trailers on residential streets within the city of New York.

Summary of provisions

Section one of the bill amends the administrative code of the city of New York by adding a new section 19-170.1. Section 19-170.1(a) defines the terms mobile home, trailer, and residential street.

Section 19-170.1(b) provides that when parking is not otherwise restricted, no person shall park a mobile home or trailer in excess of three hours on a residential street.

Section 19-170 1(c) provides that no person shall park a mobile home or trailer on a residential street from nine p.m. to five a m.

Section 19-170.1(d) provides that a violation of this section shall be punishable by a monetary fine of fifty dollars. Any subsequent violation of this section by the same owner within a six month period shall be punishable by a monetary fine of one hundred dollars.

Section 19-170 1(e) provides that any mobile home or trailer parked in violation of subdivision (b) or (c) of this section shall be subject to impoundment by the department. Any mobile home or trailer impounded pursuant to the provisions of this subdivision shall not be released until all applicable towing and storage fees have been paid. The commissioner of transportation shall be authorized to promulgate regu- lations concerning the procedure for the impoundment of mobile homes or trailers.

Section 19-170 1(f) provides that sanctions and fees provided for in this section shall be in addition to any other sanctions, fees or reme- dies provided by law or regulation.

Section two establishes that this act shall take effect on the ninetieth day after it shall become law.

Justification

Residential areas in New York City have extremely limited street park- ing, and overnight parking can present a significant challenge. Mobile homes and trailers are exceptionally large vehicles, and can take up a

substantial amount of street parking space. In order to protect the interests of New York City residents, this bill aims to limit mobile home and trailer street parking by prohibiting parking in excess of three hours, or between the hours of 9 p.m. and 5 a.m.
