BILL NUMBER:S5626B
Title of bill
An act authorizing the county of Saratoga and the Saratoga County Water Authority to transfer certain lands
Purpose
To allow the county of Saratoga to complete an equitable transfer of real property with the Saratoga County Water Authority (SCWA) in order to make improvements and upgrades to SCWA's water treatment plant.
Summary of provisions
Section 1 allows the county of Saratoga, acting by and through the county board of supervisors, to effectuate a lot line adjustment involving a portion of reforested lands described in section three.
Section 2 is the validation clause.
Section 3 describes the real property to be conveyed by the county of Saratoga pursuant to section one.
Section 4 describes the real property to be acquired by the county and dedicated for reforestation purposes, and conditions the authorization in section one upon an equal acreage transfer of real property from the Saratoga County Water Authority.
Section 5 states the effective date and the law this bill amends.
Justification
In 2008, the county of Saratoga conveyed to the SCWA a 21.86 acre parcel of county owned reforested land for the construction of a water treatment plant. Because the county conveyed the reforested parcel to SCWA for a purpose other than reforestation or one authorized by County Law § 219, the county sought and obtained home rule legislation under Chapter 439 of the Laws of the 2006. SCWA subsequently constructed the water treatment plant and all necessary appurtenances.
Recently, in the course of designing needed improvements and upgrades to its water treatment plant, SCWA discovered that portions of the water treatment facility, as constructed, enter onto adjoining reforested lands of the county. In order to remedy SCWA's entry onto the county's reforested lands, the county and SCWA have proposed an equitable transfer of real property between the two entities: (1) the westerly boundary of SCWA's parcel is expanded by 5 acres onto land currently owned by the county and (2) the southern boundary of SCWA's parcel is reduced by 5 acres, with the property restored to county ownership and re-designated as county reforested land.
