BILL NUMBER:S5628

Title of bill

An act to amend the environmental conservation law, in relation to regulation of mulch operations

Purpose

This bill requires DEC to submit proposed regulations consisting of the regulatory criteria for mulch processing and storage in counties having a population of one million or more, no later than January 31, 2016.

Summary of provisions

Section 1 adds a new section 27-0111 to the Environmental Conservation Law, relating to the regulation of mulch operations.

Section 2 is the effective date.

Justification

DEC currently has limited authority regarding the regulation of mulching operations. Over the years, mulching operations have grown, and today there are several large scale commercial mulching facilities that have been established in residential areas. The storage of large quantities of mulch presents significant health and safety concerns for the people who reside or work near these facilities. Residents who live near these large scale operations have complained, citing smell, noise, unsightly conditions, airborne pathogens, mold, spores and other nuisance issue. They also pose a fire risk.

This bill directs DEC to promulgate revisions to the solid waste regulations, giving them authority to regulate large mulching operations in counties with a population of one million or more, no later than January 31, 2015
