BILL NUMBER:S5689

Title of bill

An act authorizing the Suffolk Islamic Center, Inc. to receive retroactive real property tax exempt status

Purpose or general idea of bill

To grant the town assessor for the town of Brookhaven the authority to accept a late application for exemption from real property taxes for the Suffolk Islamic Center for the 2012-2013, 2013-2014 and 2014-2015 assessment rolls.

Summary of provisions

Section One authorizes the assessor of the town of Islip to accept a late application from the Suffolk Islamic Center for exemption from real property taxes pursuant to Section 420-a of the real property tax law for the assessment roll pertaining to the years 2012-2013, 2013-2014 and 2014-2015. Upon satisfaction that the Suffolk Islamic Center would have otherwise been entitled to said exemption, but for their late filing, the assessor may grant this exemption.

Section Two is the effective date.

Justification

The Suffolk Islamic Center, Inc. has purchased a piece of real property located in the Town of Brookhaven. It is intended by this bill to undo the hardships that will be suffered if the organization is required to pay property taxes that would otherwise not be due, if the organization had submitted their application for exemption in a timely manner.

Existing law authorizes tax exemptions to be granted after the taxable status date has passed, only if a bill is chaptered by the state legislature, authorizing the assessor to accept a late application.
