BILL NUMBER:S5700A
Title of bill
An act to amend the retirement and social security law, in relation to the membership of police officers and firefighters
Purpose
To provide equitable disability benefits and retirement benefits for uniformed services across the state of New York.
Summary of provisions
Section one reinstitutes Tier 2 disability benefits for members currently in Tier 3 statewide, and includes all corrections and sanitation members of the NYC Employee's Retirement System who became members on or after April 1, 2012.
Section two provides that this act shall take effect immediately.
Justification
In 2009, Governor Paterson approved the Tier V benefit plan. New York City employees were not subjected to Tier V, leading newly hired New York City Police and Fire members to become members of the original Article 14 Tier III pension plan. Tier III provides very limited disability benefits, which are only 50% of the member's final average salary, which is reduced by 50% of the primary social security benefit received. This bill would also pertain to Tier III Sanitation and Correction members hired after April 1st, 2012.
Furthermore this bill would provide equity across the state for uniformed personnel who get injured in the line of duty and at no fault of their own were thrown into this conundrum due to the Governor's veto in 2009.
