Title of bill
An act to amend the agriculture and markets law, in relation to farm trails, apple trails and cuisine trails
Purpose
To expand the successful program that established farm trails, apple trails, and cuisine trails so that they can further economic development opportunities in our Upstate areas and promote the State's agricultural, food processing, and tourism industries.
Summary of provisions
Section 1: Amends Agriculture and Markets Law section 284-a(2)(c) to expand the definition of those products that can be sold, used or promoted on cuisine trails to include, in addition to wine, other alcoholic and/or nonalcoholic beverages.
Sections 2 and 3: Amends Agriculture and Markets Law section 284- a(3)
(b) and (c) to expand the number of farm, apple, and cuisine trails from 10 to 15. In addition, it makes it clear that the Department, if asked to, can use any other descriptive language or trail name to designate its trail, as long as such name helps to promote the marketing of such trail's agricultural products, such as, and purely for example, names such as a beverage, hops, herbs or fruit trail.
Section 4: Amends Ag. & Markets Law section 284-a (4)so that names, other than apple, farm or cuisine trails can be used to designate such a trail as long as it helps to promote the marketing of such trail's agricultural products.
Existing law
Since the law was last amended in 2008, the apple, farm and cuisine trails programs have been successful and needs to be expanded to accommodate the heightened state-wide interest in establishing more of these trails.
Justification
The experience of the Department of Agriculture and Markets, the administrator of this agri-tourism program, is that there may be many more applications for such trails than the number of trails that are currently authorized under the law. This bill expands the number of trails. The Department of Agriculture and Markets should have expanded authority to grant more trail applications so that they can meet the needs of the trail applicants and their marketing plans.
