Title of bill
An act to amend the workers' compensation law and the retirement and social security law in relation to participants in the World Trade Center rescue
Purpose
To extend the period for filing a claim relating to World Trade Center rescue, recovery, and clean-up operations.
Summary of provisions
Section 1 of this bill amends Workers' Compensation Law section 162 to open up registration of participation in World Trade Center rescue, recovery and clean-up operations to September 11, 2017.
Section 2 of this bill amends Workers' Compensation Law section 168 to add a new subdivision 3 which provides that a claim by a participant in the World Trade Center rescue, recovery or cleanup operations would not be barred if the claim is filed on or before September 11, 2017 if the disablement occurred between September 11, 2012 and September 11, 2015.
Section 3 of this bill amends Retirement and Social Security Law section 2(36)(a) to extend the application period to 2017.
Section 4 of this bill states that notwithstanding any other provision to the contrary, none of the provisions of this act shall be subject to Retirement and Social Security Law section 25.
Section 5 of this bill provides that this act shall take effect immediately and shall be deemed to have been in full force and effect on and after September 11, 2001; provided, however, that the amendments to sections 162 and 168 of the Workers' Compensation Law made by sections one and two of this act, respectively, shall apply to all open and closed claims coming within its purview.
Justification
This bill would allow any participant who was disabled between September 11, 2012 and September 11, 2015 to file a claim before September 11, 2017. If a participant filed a claim in this period and was disallowed, the application will be reconsidered by the Workers' Compensation Board.
This bill will correct any inequity relating to denied applications for World Trade Center qualifying conditions during this time period.
