BILL NUMBER:S5820
Title of bill
An act to amend chapter 524 of the laws of 1987, relating to establishing the Greater Poughkeepsie library district, in the city and town of Poughkeepsie, Dutchess county, in relation to the election of trustees and the annual budget of such library
Purpose
This bill establishes a procedure for the election of the trustees of the Poughkeepsie Library District to be held on the third or fourth Tuesday of October and requires the trustees to hold the annual budget vote on the date of the general election.
Summary of provisions
Section one establishes the procedures for the annual election of the library trustees of the Poughkeepsie Library District to be held on the third or fourth Tuesday of October.
Section two provides that the annual budget vote for the Poughkeepsie Library District shall be held on the date of the general election.
Section three sets an immediate effective date.
Existing law
The Poughkeepsie Library District currently holds its annual budget vote and election of the trustees on the date of the General Election.
Justification
In 2014, the Dutchess County Board of Elections notified the Poughkeepsie library district that the Board lacked the statutory authority to conduct the library district election process. As a result the library district sought an order in the nature of mandamus compelling the Board to include the library district's ballot proposition at the November general election. While the decision resulted in the Board of Election including the library district's budget proposition on the ballot for the 2014 general election, the library district recognized that legislation is necessary to clarify the election process for future elections.
At present, the vote of the library trustees and the budget proposition are included on the ballot in the general election. While the library district chooses to keep the budget proposition on the ballot for the general election with clarifying language establishing the role of the Board of Election, the library recognizes the shortcomings of placing trustees who do not run on party lines on the general election ballot. As a result the library has requested the ability to hold their own trustee election on either the third or fourth Tuesday of October to avoid any misconception that any trustee is aligned with a political party.
This bill is submitted at the request of the Poughkeepsie Library District Board of Trustees.
