BILL NUMBER:S5826A
Title of bill
An act to amend the real property tax law, in relation to authorizing eligible surviving members of the household to apply for a transfer of the head of household's benefit under the SCRIE and DRIE programs
Purpose
An Act to amend the tax real property law to permit the transfer of benefits to an eligible surviving member of the household applying to the appropriate rent control agency or administrative agency within six months of the head of the household's death or ninety days of the date of notice from the NYC Dept of Finance, whichever is longer, on a form prescribed by the agency to transfer such exemption to the surviving member of the household.
Summary
This bill would amend section 467-c of the real property tax law and add a new subdivision 4-a, to permit the transfer of benefits to an eligible surviving member of the household applying to the appropriate rent control agency or administrative agency within six months of the head of the household's death or ninety days of the date of notice from the NYC Dept of Finance, whichever is longer, on a form prescribed by the agency to transfer such exemption to the surviving member of the household.
Justification
Families experiencing loss have many decisions to make in addition to coping with grief. Current policy only allows sixty days to transfer SCRIE or DRIE benefits to an eligible surviving household member. This bill will extend the takeover period to six months of the head of the household's death or ninety days of the date of notice from the NYC Dept of Finance, whichever is longer. Additional time to maintain SCRIE or DRIE benefits would prevent unmanageable rent increases and allow older or disabled New Yorkers a reasonable opportunity to remain in the communities they built.
