BILL NUMBER:S5832A

Title of bill

An act to amend the criminal procedure law, in relation to grand jury proceedings and operation

Purpose

The purpose of this bill is to amend Chapter 347 of the Laws of 2014 to include financial crimes among those crimes for which a vulnerable elderly person would be permitted to be accompanied by a professional support person whenever that elder is called before a grand jury to give evidence, provided the district attorney consents.

Summary of provisions

Section 1 amends the criminal procedure law, as amended by Chapter 347 of the Laws of 2014, to include financial crimes.

Section 2 provides for an immediate effective date.

Justification

When Chapter 347 was signed in 2014, it did not account for the emotional and physical stress that an elderly person may experience when asked to testify in cases involving financial crimes. As a result of adding new language including vulnerable elderly witnesses to the subdivision originally drafted for child witnesses, the law does not apply to any financial crimes. To fix this discrepancy, financial crimes must be added to the list of crimes for which a vulnerable elderly person would be permitted to be accompanied by a professional support person whenever that elder is called before a grand jury to give evidence.
