Title of bill
An act to authorize the Legal Aid Society of Northeastern New York to retroactively apply for a real property tax exemption for certain properties in the city of Saratoga Springs
Purpose
To authorize the Legal Aid Society of Northeastern New York to apply to the Assessor of the county of Saratoga for a retroactive real property tax exemption on a certain parcel of land.
Summary of provisions
Section one authorizes the Assessor of the County of Saratoga to accept from the Legal Aid Society of Northeastern New York an application for exemption from real property taxes pursuant to section 420-a of the real property tax law for the 2014 assessment roll with respect to school taxes and the 2014 assessment roll with respect to the general taxes for the parcel owned by the Legal Aid society. The city of Saratoga Springs has agreed to grant a retroactive exemption once the appropriate state authority is granted.
Section 2 establishes an effective date.
Justification
The Legal Aid Society of Northeastern New York, a not-for-profit entity, purchased property in the City of Saratoga Springs, County of Saratoga in October 2013 from a charitable organization. Due to the tax laws at the time the property was transferred, the exemption granted to the charitable organization was cancelled. The result was that the Legal Aid Society incurred outstanding city, county and school tax liability. Additionally, the Legal Aid Society failed to fill out their required application forms in time for preparation of the tentative tax roll. The Legal Aid Society applied for the appropriate tax exemption in December 2013 which was granted as of January 1, 2015.
